NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. HOW TO ENTER

a. These rules govern the “XRT 4D Concert with Mumford & Sons: Captain Morgan Black” promotion (the “Promotion”) being conducted by WXRT-FM (the “Station”) beginning at 12:01AM Central Time (“CT”) on 7/23/2012 and ending at 9:00PM CT on 8/15/2012 (“Entry Period”).

b. To participate in the Promotion, you may enter online or by text or on-site at a Station event(s).

To enter online: Between 12:01AM CT on 7/23/2012 and 9:00AM CT on 8/10/2012, log onto http://www.93XRT.com and follow the links and instructions to enter the Promotion and submit during the Entry Period your first name and last name, complete address, city, state, zip code, telephone number, date of birth and a valid email address in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Promotion.

c. To enter by text: Between 12:01AM CT on 7/23/2012 and 9:00AM CT on 8/10/2012, text the keyword “BLACK” to short code 59393 during the Entry Period. Message and data rates may apply, and the Station is not responsible for any fees incurred by an entrant for this method of entry. There is no limit to the number of entries received by either method of entry. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems or for telephone service outages, delays, equipment malfunctions and any other technological difficulties that may prevent an individual from sending a text message or online entry.

All online and/or text entries must be received by 9:00AM CT on 8/10/2012.

To Enter On-site
To participate in the Promotion, attend one (1) of the “Station Events” listed below and complete an official on-site entry form (while supplies last) including your first name and last name, complete address, city, state, zip code, home telephone number and date of birth, and put the entry form in the designated registration box. All entries must be received by the indicated closing time at each Station Event during regular advertised hours. The Station is not responsible for lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late entries. All onsite entries must be received by 09:00PM CT on 8/15/2012.

1. Wednesday 8/8: Finley Dunns located at 3458 North Lincoln Avenue Chicago, IL 60657 from 7pm-9pm CT
2. Wednesday 8/15/12: Red Ivy located at 3525 North Clark Street Chicago, IL 60657 from 7pm-9pm CT
3. Wednesday 8/15/12 Bull & Bear located at 431 N Wells Chicago IL 60654 from 7pm-9pm CT

d. Entrants may submit an unlimited number of entries but an entrant may be a prize winner only once during the Promotion.

2. ELIGIBILITY RESTRICTIONS

a. The Promotion is open to U.S. residents, who are 21 years of age or older as of 08/15/2012 who reside in the Chicago Arbitron Metro Area (Cook, DuPage, Grundy, Kane, Kendall, Lake, McHenry, & Will Counties, IL; Lake & Porter Counties, IN; and Kenosha County, WI). Employees of Captain Morgan Black Spiced Rum, Diageo North America, the Station, its licensee, each of their respective parent, subsidiary and affiliated entities, the Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the Chicago metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. (CBS Radio East Inc. and the Station shall be collectively referred to as the “Contest Entities”).

b. Only one (1) winner per household is permitted in any Station-conducted promotion.

c. Each winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number and sign and return all required releases in order to claim prize.

d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. PRIZES
a. Twenty (20) prizes will be awarded in this Promotion. Each prize will include the following provided by Captain Morgan Black Spiced Rum, Diageo North America:
• Two (2) VIP tickets (for the winner and one (1) guest) to XRT 4D Concert with Mumford & Sons at Chicago Theatre (175 N State St, Chicago, IL 60601). Valid on August 16, 2012 at 8:00pm CT.
Approximate Retail Value (“ARV”) of each prize: $180.00

b. ANY GIFT CERTIFICATE/GIFT CARD/TICKETS WILL BE SUBJECT TO THE TERMS AND CONDITIONS AS SET FORTH BY THE ISSUER OF THE GIFT CERTIFICATE/TICKETS.

c. All federal, state and local taxes on prizes are solely the responsibility of the prize winners. Travel arrangements must be made by winner and will not be provided by the Station. Tickets will not be extended, and tickets will not be refundable or redeemable for cash or credit at any time, nor will tickets be replaced if lost or stolen. Tickets may not be sold to a third party.

d. All prizes are awarded pending confirmation of eligibility. Prize is subject to availability. If prize winners cannot attend on dates specified by the Contest Entities, the prize winners may be disqualified and an alternate winner may be selected in the Station’s sole discretion. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips, and ground and/or air transportation to/from any prize-related event, are the responsibility of each winner. The winner and travel companion(s) may be required to sign a Publicity and Liability Waiver prior to attending any prize-related event. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Contest Entities, the Contest Entities’ sole responsibility to prize winner will be to award the remaining available portion of the prize and no substitution will be provided for unawarded portion of prize. The Station reserves the right to remove or to deny entry to the winner and/or companion if either engages in a disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at any prize-related event.

e. The Station accepts no responsibility for repairing any real or supposed damage to any prize.

f. All prizes or prize certificates may be picked up at the office of the Station during regular business hours at the address below. The prize winners will forfeit their prize if not claimed by 5pm CT on August 12, 2012. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

g. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of the Station management with respect to the Promotion are final.

b. On 8/10/12 at approximately 9:00AM CT, ten (10) potential prize winners will be randomly selected through a random drawing from all eligible text and online entries received. Potential prize winners, who entered via online/text entry, will be notified by the Station on 8/10/2012 immediately following the respective prize winner drawings by phone and email. If prize winner cannot be reached by 5pm CT on 8/10/2012, winner forfeits prize and an alternate winner may be selected through a random drawing from all remaining text/online entries. Prizes will be awarded upon confirmation of eligibility.

c. At the end of each of the three (3) Station Events, the Station will select ten (10) on-site prize winners through a random drawing from all on-site entries submitted at each Station Event, respectively. Up to ten (10) prizes will be awarded at each Station event for a maximum total of thirty (30) prizes awarded to on-site entrants. The Station will announce the names of the potential prize winners following each on-site prize winner drawing. The potential on-site prize winner will have three (3) minutes from the time his/her name is announced to come forward to claim the prize. If an on-site potential prize winner does not come forward within three (3) minutes of the winner announcement, that on-site prize winner will forfeit his/her prize and an alternate winner may be selected through a random drawing from all remaining on-site entries. Prizes will be awarded upon confirmation of eligibility.

d. Entrants who enter via text/online entry need not listen to the Station nor be present to win. On-site entrants must be present but need not listen to the Station to win.

e. Odds of winning a prize through online and/or text entry depend upon the number of text and online entries received. Odds of winning a prize through on-site entry at the three (3) Station Events depend upon the number of entries received during each respective Station Event.

f. Prize winners selected on-site must execute and return any required affidavit of eligibility and/or liability/publicity release on-site on the date of the respective prize winner drawing in which they are selected or prize will be forfeited and an alternate winner may be selected by a random drawing from remaining entries. Online/text entrants who are selected as prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release within two (2) days of notification or prize will be forfeited and an alternate winner may be selected by a random drawing from remaining online and/or text entries. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For the names of the prize winners send a self-addressed stamped envelope for receipt by 10/15/2012 to the above address marked “XRT 4D Concert with Mumford & Sons: Captain Morgan Black”-Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at http://www.93XRT.com.

6. PRIVACY

a. By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreement located at http://www.93XRT.com and to the use of your personal information as described in the Privacy Policy located at http://www.93XRT.com
